Outcome of time to train appeal meeting

Where an employee has appealed against your decision to decline their time to train application and you’ve held an appeal meeting, the final stage is to notify them in writing of the outcome of their appeal within 14 days of the appeal meeting. Use our outcome of time to train appeal meeting letter for this and be aware that your decision on their appeal is final.

Outcome of appeal

Essentially, what your Outcome of Time to Train Appeal Meeting letter needs to include depends on whether you: (1) still decline the employee’s request; (2) now accept their request; (3) now accept their request in principle but believe their training needs could be met in a different way to their proposal; or (4) now accept part of their request. If you still wish to decline their request on appeal, you must send the employee written notification of your refusal of their appeal, which includes:

  •       the business ground, or grounds, for your decision
  •       a sufficient explanation as to why the business ground, or grounds, applies in the circumstances
  •       the date of your appeal decision notice. 

 

If you now wish to agree to the employee’s request on appeal, you must provide them with written notification of your acceptance of their appeal which contains the same information as is included within the Time to Train Acceptance Letter, i.e. information relating to:

  •       the subject of the study or training
  •       where and when you expect it will take place and over what period
  •       who will provide or supervise the training
  •       what qualification (if any) the training will lead to the award of
  •       how the training time will be taken, i.e. will it be paid or unpaid and will there be any changes to the employee’s working hours in order to accommodate the training?
  •       how any tuition fees or other direct costs of the training will be met
  •       the date of your appeal decision notice. 

If, at the appeal meeting, you reach an agreement with the employee to meet their training needs in a different way, your letter should contain details of that agreement, including written evidence of their agreement to it. If this is the outcome, our letter confirms the employee’s agreement and encloses the appeal meeting minutes for the employee to sign and return to provide written evidence of their acceptance. Finally, where the employee requested more than one type of study or training, on appeal you might accept only part of that request. In this case, your letter must include all of the information listed in the second set of bullet points above and make clear which part of their application is now accepted and which part is still refused on appeal. In relation to the part still refused, it must also include:

  •       on which business grounds the part of the application is still being turned down
  •       a sufficient explanation as to why the business grounds apply in the circumstances.
