Introduction to this document

Letter notifying change to adoption leave dates

This letter may be used where an employee wishes to change the start date of their adoption leave. The letter must be sent within 28 days of the employee's notice to change the start date and sets out the new adoption leave end date.

Employee changing start date

You can require any notice to change the adoption leave start date to be in writing. An employee can change their date if they give 28 days’ notice of the new start date. If insufficient notice is given, you may choose to accept the new date but you are not obliged to do so (unless it was not reasonably practicable for the employee to give the required 28 days’ notice and they gave notice as soon as it was reasonably practicable).

Where the change is to enable the employee’s adoption leave to now begin on the date on which the child is actually placed with them for adoption, they must give you at least 28 days’ notice before the date they specified in their original notice as the date on which they expected the child to be placed with them for adoption. Where the change is to enable the employee’s adoption leave to now begin on a predetermined date, or a different predetermined date, they must give you at least 28 days’ notice before that date.
