Introduction to this document

Letter to solicitors

If you have a major dispute with someone, perhaps a customer or supplier, they may put their solicitors on the case before issuing legal proceedings. Our simple letter shows how you should respond without prejudicing your position.

Advice

If any legal matters are issued against you, an immediate written response must be made. If you fail to respond, your interests may be prejudiced and the claimant may proceed to issue court proceedings immediately.

Proper legal advice must be sought

The initial response is an acknowledgement of receipt of their letter together with an implied request for reasonable time to reply in detail. Their letter may be a surprise to you. If you were aware of a significant dispute beforehand, it’s best to take advice early and prepare your defence.

Tip

Do not telephone the claimant direct to negotiate the detail. There will be a time for this later - on the advice of your own solicitors.
