Agency workers checklist

Whilst temps are useful in helping you plug gaps in staffing levels, you have to take into account your obligations under the Agency Workers Regulations 2010. Temps are also at greater risk of accidents due to lack of familiarity with your workplace. Comply with the Regulations and reduce these risks by working through our checklist.

Protecting agency workers

At some point you’re likely to need some temporary help from an employment agency to tide you over in the event of a holiday or unexpected sickness absence. Whilst this will provide you with the extra cover, it may also mean that you have a temp who is unfamiliar with your workplace and working practices.

To keep on the right side of the law use our Agency Workers Checklist. It covers the actions you need to take to ensure a smooth and safe transition of the worker into your workplace.

The first section covers the employment status of agency workers. This is important as it will prompt you to take steps to ensure that you don’t inadvertently assume the legal role of the temp’s employer.

The remaining five sections cover the various aspects of health and safety, providing you with the right questions to ask any agency. They look at health and safety responsibilities, provision of relevant health and safety information, selection of candidates, identification of needs, division of responsibilities between you and the agency and training.
